Please read these terms carefully before booking any tours or services with Hope Pow Tours.
These terms and conditions govern the contract between Hope Pow Tours ("we", "us", "our") and the client ("you", "your"). By booking any tour or service with us, you agree to be bound by these terms.
A booking is considered confirmed only upon receipt of a completed booking form and the required deposit. We will issue a written confirmation of booking at this time. The person making the booking accepts responsibility for ensuring that all members of their party are aware of and agree to these terms.
All bookings are subject to availability. We reserve the right to decline any booking at our discretion.
A non-refundable deposit of 30% of the total tour cost is required to confirm a booking. The remaining balance is due no later than 60 days before the tour departure date. For bookings made within 60 days of departure, the full amount is payable at the time of booking.
All prices quoted are in the currency stated on your invoice and are inclusive of the taxes specified. We reserve the right to adjust prices in the event of significant changes in fuel costs, government taxes or exchange rates, provided we give you reasonable notice.
All cancellations must be received in writing. The following cancellation charges apply based on the number of days before departure:
We strongly recommend comprehensive travel insurance that includes cancellation cover.
We will endeavour to operate all tours as described. However, we reserve the right to modify itineraries where circumstances beyond our control make this necessary, including adverse weather conditions, road closures, wildlife activity, civil unrest or force majeure events. In such cases, we will provide the best reasonably available alternative at no additional cost.
Our liability to you is limited to the total cost of your booking. We accept no liability for loss, damage, injury or death arising from circumstances beyond our reasonable control, including but not limited to acts of God, wildlife encounters, third-party supplier failures or client negligence.
Wildlife safaris involve inherent risks. By booking, you acknowledge these risks and accept them as part of the experience.
You are responsible for ensuring you are in good physical health and mental fitness for the tour you have booked. You must inform us of any medical conditions, disabilities or dietary requirements at the time of booking. We reserve the right to exclude any client whose condition may endanger themselves or others.
You must comply with all health regulations applicable to the countries visited, including vaccination requirements.
Comprehensive travel insurance is mandatory for all clients. This must include cover for medical emergencies, evacuation, cancellation and personal liability. You must carry proof of insurance at all times during your tour. We accept no liability for losses that would have been covered by adequate insurance.
You are expected to behave in a manner that is respectful to wildlife, local communities, guides and fellow travellers at all times. We reserve the right to remove any client from a tour, without refund, if their behaviour is deemed dangerous, disruptive or damaging to the environment or third parties.
Any complaint should be raised with your guide or our representative at the time, so that we have the opportunity to resolve it. If satisfaction is not achieved on tour, a formal complaint must be submitted in writing within 28 days of return. We will acknowledge your complaint within 7 days and aim to resolve it within 28 days.
These terms are governed by the laws of Kenya and any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.
